Terms and Conditions
The placement for an order for materials and service, whether orally or in writing, constitute client’s agreement to the terms and conditions of this rate card. Terms and conditions are subject to change. Please make sure you have our current rates and terms prior to booking. Previously approved credit accounts are due within 30 days of invoice. Overdue accounts will be assessed 1% per month as a service charge. Without prior credit approval, terms are cash or credit card with signature of terms upon booking. We will retain a proprietary interest in any and all work performed until such time as all charges incurred are paid in full. In the unfortunate event that we incur costs to collect any sums lawfully due, we shall be entitled to said costs, expenses and damages, including reasonable attorney fees, incurred in connection therewith.
Deposits shall be held for bookings for no more than 90 days. If no bookings result by the responsible booking party the deposit is null and void. All deposits are fully refundable within 90 days within the guidelines of the cancellation policy.
All clients need to purchase a firewire drive or master tape commencing their project. We will gladly sell these Firewire drives and/or master tapes to the client at the rate published in our brochure and website. We do not store projects on our system for long term storage and once a project is complete we delete all projects on our system. If the client does not provide a firewire drive than it is at the client’s risk if all or part of their project is lost. All lost work due to not purchasing a master will be at the client’s risk and Client agrees to indemnify Acoustic Chambers Kent and its officers, directors, agents, or employees against and hold each of them harmless from any and all claims, costs, losses detriments and expenses of any kind or nature including with our limitation, attorney’s fees and costs incurred by Acoustic Chambers Kent by reason of any breach or alleged breach of any representation, warranty or agreement made by client.
You may cancel your reservation free of charge if notification is given during regular business hours at least 48 hours prior to the date do the session. We ask for a Visa or MasterCard security deposit before booking time. This deposit will be used in the event of a missed appointment without proper 48-hour cancellation notice. In the event that a check is returned for any reason, the Visa or MasterCard provided will be charged as a phone order.
A) Acoustic Chambers charges 50% of the booking without proper 48-hour cancellation notice.
B) There will be a $25.00 NSF charge for all returned checks
C) All payments are made at the end of the session if client has no ability to pay through cash or check than the Visa and or MasterCard held for the deposit will be charged for the session time. We always welcome Visa or MasterCard payments.
Client represents and warrants the tape and or audio materials delivered to Acoustic Chambers Kent do not in any way defame, violate, or infringe on copyrights, civil rights of privacy, or any other rights of any person, firm or corporation. Client agrees to indemnify Acoustic Chambers Kent and its officers, directors, agents, or employees against and hold each of them harmless from any and all claims, costs, losses detriments and expenses of any kind or nature including with our limitation, attorney’s fees and costs incurred by Acoustic Chambers Kent by reason of any breach or alleged breach of any representation, warranty or agreement made by client.
We will ship collect or third party bill, subject to a nominal packaging and handling fee at client’s request, we will ship prepaid and rebill the charges plus a normal markup.
We will add to all invoices any applicable city, state and federal taxes.
For loss or damage to client from defects in material, equipment and or negligence of Acoustic Chambers Kent personnel, Acoustic Chambers, Kent will again perform the recording service without charge but all damages, consequential or otherwise, are expressly assumed by client. Acoustic Chambers Kent makes no warranties, express or implied, with reference to services and or personnel furnished by it, and shall not be liable for any delays in the delivery of supplies, material or work product, nor for any failure to perform the services for any cause whatsoever, including, but not limited to, act of god, fire, strike, labor disturbance, civil commotion, acts of government or its agencies and officers, or any order regulation, ruling or any labor union or association of employees affecting Acoustic Chambers Kent or the industry in which its engaged.
Client will obtain all rights and licenses for recording and pay all sums due including, but not limited to (1) applicable Sales Taxes and Excise Taxes, (2) All talent and copyright costs, and will indemnify and hold Acoustic Chambers Kent harmless against all loss or damage (including attorneys’ fees) by reason of customer’s failure to pay such sums
We will exercise care in the handling and storage of all client properties left or stored on our premises. However, we cannot assume any liability for loss or damage to any such properties. If properties of value are left on our premises for file or storage, we recommend the appropriate insurance be secured by the client to cover their full value. Client’s tapes & masters ( Firewire Drives ) will be stored at the client’s own risk and for a maximum of six months with consecutive bookings. $50.00 tape rentals extend for 3 months with consecutive bookings. After the initial 3 months a new rental charge will be reinstated. $25.00 master tape rentals are cleared immediately after the one of only one session. This also applies to all A-DAT rentals. Ask about our option to buy.
All mastering packages allow for one final tune-up after the reference CD. All packages come with two CD's inclusive of the reference CD. All masters stored on the hard drive for CDR burning are only held until the final PMCD is burned. At the final PMCD the material on the hard drive is then deleted. Safety copies to DAT are recommended and are solely the responsibility of the client.
